Commissioner for Oaths

Commissioner for Oath services are available at the Pahang State Court to carry out the tasks of swearing documents - documents that require verification by oath. The swearing of this documentation is based on the Statutory Declarations Act 1960 (Revised 2016), the Rules of the Commissioner of Oaths 1993 and where written laws require sworn declarations.

Service Charge

  • Service fee for sworn affidavits and documents other than statutory declarations
    • Based on Rule 17 read together with the Second Schedule, Rules of the Commissioner of Oaths 2018, the fee charged by the Commissioner of Oaths is RM10.00 (original affidavit for each deponent), RM5.00 (copy of affidavit for each deponent), RM5.00 ( each original exhibit) and RM2.00 (each copy of the exhibit). The Commissioner of Oaths is also allowed to collect RM10.00 for each document other than the statutory declaration which the Commissioner of Oaths has been authorized by law to sign for example DDA form, power of attorney.
  • The fee charged for signing a statutory declaration letter
    • According to Section 2 of the Statutory Declaration (Amendment) Order (Payment) 1993, the fee charged is RM4.00 (for each declaration) and RM2.00 (for each exhibit or attachment referred to it). There is no copy term for the statutory declaration.

 

Definition

  • A Commissioner of Oaths is a person appointed by the Chief Judge of the Federal Court under section 11(1) of the Court of Justice Act 1964 and the Commissioner of Oaths Rules 2018.

 

Objectives of the Oath Commissioner Unit

  • The objective of the Commissioner of Oaths Unit is to manage the affairs of Commissioners of Oaths throughout Malaysia in an efficient, efficient and orderly manner to ensure the effectiveness of the duties undertaken by the Commissioners of Oaths who indirectly contribute to the judiciary.

Regulations

  • The laws that allocate powers and control the conduct and duties of the Commissioner of Oaths are the Rules of the Commissioner of Oaths 2018 and the Statutory Declaration Act 1960.
